Waldura.org is operated by the Waldura Foundation, a non-profit organization based in San Francisco, California, USA.
Membership is available solely to members of the Waldura family, i.e. bearers of the lastname "Waldura". The Waldura Foundation reserves the right to decide whether an individual is indeed attached to the Waldura family, and whether membership should be granted to them.
Prospective members are required to submit a membership request through the Foundation's Web site at www.waldura.org.
Membership and its associated benefits ("the service") may be terminated at any time, for any reason. No explanation or justification need to be offered by the Waldura Foundation to the member involved in the termination.
Services offered to members of the Waldura Foundation (henceforth referred to as "the service") currently consist of:
The service is provided entirely free of charge and for an unlimited duration to all members.
All support requests and requests for changes to the service are handled by e-mailing to foundation@waldura.org. Requests will be handled in order of arrival and time permitting.
No guarantees of service are provided in any way whatsoever. The Waldura Foundation shall not be held responsible for any degradation/interruption of service, including but not limited to, lost e-mails and lost Web traffic. See also Section 3. "Limitation of Liability" below.
The service as a whole is susceptible to be terminated to all users, at any time, should the Waldura Foundation decide to do so. Since the service is free of charge, no compensation will be offered.
All members of the Waldura Foundation are required to comply to our Acceptable Usage Policy at all times. Refusal to do so will result in the immediate termination of your membership and all its associated benefits.
Your personal information will not be disclosed to any third party, at the exception of Waldura Foundation associates and affiliates, and if so anonymously and solely for the purpose of enhancing the quality of our service.
The Waldura Foundation may ask your ancestry information as well as detailled personnal information for the purpose of tracking the evolution of the Waldura family over the ages. You are required to provide that information, and in return will be granted access to the results of our study.
USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT USER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN ``AS IS'' AND ``AS AVAILABLE'' BASIS. The Waldura Foundation EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. The Waldura Foundation MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES the Waldura Foundation MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.
USER OR SO CALLED CLIENT UNDERSTANDS AND AGREES THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT USER'S OWN DISCRETION AND RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO USER'S COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA.
The Waldura Foundation MAKES NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SERVICE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SERVICE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY USER FROM the Waldura Foundation OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
The Waldura Foundation SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASE OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF the Waldura Foundation HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
